Emerald Lawn & Land Creations (E.L.L.C.) provides landscape design, consulting, and construction services based on professional experience, industry standards, site conditions, and client-provided information.

While all efforts are made to ensure accuracy and quality, the following conditions apply:

All designs, plans, and recommendations are conceptual unless otherwise specified as construction-ready or permit-ready documents.
Site conditions (including but not limited to soil composition, drainage behavior, underground utilities, and grading constraints) may vary and can impact final outcomes.
E.L.L.C. is not responsible for unknown subsurface conditions, concealed structures, or pre-existing site issues not visible or disclosed at the time of design or construction.
Plant material is a living product and subject to environmental conditions, proper maintenance, and acts of nature. No guarantees are made beyond any explicitly stated warranty.
Renderings, 2D plans, and 3D visualizations are representative in nature and may not reflect exact final construction details.

By engaging services with E.L.L.C., the client acknowledges and accepts these conditions.

Deposits & Payment Terms:

A non-refundable project deposit of 25%–50% is required to secure scheduling, allocate resources, and initiate design or pre-construction planning.
Deposits are considered partially earned upon receipt due to consultation time, project reservation, administrative costs, and opportunity allocation.
Progress payments may be required at defined project milestones.
Final payment is due upon substantial completion unless otherwise stated in writing.

Refund Policy - the basics

Design Phase Refund Policy

Before Design Work Begins:

75%–90% of the deposit may be refunded
10%–25% retained for administrative, consultation, and scheduling costs

After Design Work Has Begun:

Refund = Deposit minus work completed
Minimum 25%–50% of total design fee retained

After Design Completion:

All design fees are 100% non-refundable

Construction Phase Cancellation Policy

Before Construction Begins:

20%–30% of total contracted value retained for scheduling, planning, and lost opportunity costs

After Materials Are Ordered:

Client is responsible for:
- 100% of material costs
- 15%–25% cancellation fee

After Construction Has Begun:

Client is responsible for:
- All completed work
- All materials (installed or ordered)
- 10%–20% of remaining contract value (overhead and profit)

Change Orders & Scope Modifications:

Any changes to the agreed scope of work must be documented and approved in writing.
Additional work may require:
- Revised pricing
- Additional deposits
- Timeline adjustments

E.L.L.C. reserves the right to pause work until change orders are approved.
