Acceptance of Terms:
By accessing this website or engaging in services with Emerald Lawn & Land Creations (“Company,” “we,” “our,” or “us”), you agree to be bound by these Terms & Conditions. These terms apply to all visitors, clients, and users of our services.
Scope of Services:
Emerald Lawn & Land Creations is a full-service landscape design-build firm providing, but not limited to:

Landscape design (2D & 3D renderings)

Grading, drainage, and erosion control solutions
-
Irrigation system installation and repair
-
Sod and planting installations
-
Hardscapes and retaining walls
-
Outdoor living spaces (kitchens, patios, pergolas, etc.)
-
Custom pool design and installation
-
Lighting systems
-
Project consultation and planning
All services are performed in accordance with industry standards, manufacturer specifications, and best practices applicable to the Southeastern United States.
Estimates, Proposals & Design Agreements:

All estimates are valid for 14–30 days, unless otherwise stated.

Pricing is subject to change due to material costs, site conditions, or scope modifications.
-
Design services may be required prior to construction and are billed separately unless otherwise agreed.

Conceptual designs represent intended vision, not exact construction documents unless specified.
Deposits & Payment Terms:
-
A 25%–50% deposit is required to secure scheduling and initiate project planning.
-
Progress payments may be required based on project milestones.
-
Final payment is due upon substantial completion of work.
-
Late payments may result in project delays, suspension of work, or additional fees.
Cancellations & Refund Policy:
Design Phase:
-
Prior to design start: 75%–90% refundable
-
After design has begun: refund = deposit minus work completed (minimum 25%–50% retained)
-
After design completion: non-refundable
Construction Phase:
-
Before construction: 20%–30% retained
-
After materials ordered: client responsible for material costs + 15%–25% fee
-
After construction begins: client responsible for completed work + materials + 10%–20% overhead/profit
Change Orders:
Any changes to the original scope must be approved through a written change order, which may affect:

Project cost

Timeline
-
Material availability
Work will not proceed on changes without client approval.
Project Timeline:
Estimated timelines are subject to:

Weather conditions
-
Material availability
-
Permit approvals
-
Site conditions
We strive for efficiency but do not guarantee exact completion dates.
Site Conditions & Unforeseen Circumstances:
Client acknowledges that unforeseen conditions may arise, including:

Hidden underground utilities
-
Poor soil conditions
-
Drainage complications
-
Rock or debris below grade
Additional work required will be addressed through a change order.
Permits & HOA Approvals:
-
The client is responsible for obtaining HOA approvals unless otherwise specified.
-
The Company may assist with permits, but approval is not guaranteed.
-
Delays caused by permitting or HOA review are not the responsibility of the Company.
Plant Material & Warranty:
-
Plant material is installed following horticultural best practices.
-
Due to variables beyond our control (weather, watering, soil, pests), no standard warranty is provided unless enrolled in a maintenance program.
Optional Warranty Program:
A plant warranty may be offered only through an active maintenance agreement, which includes:

Proper watering and care
-
Scheduled inspections
-
Seasonal adjustments
Without this program, plant survival is not guaranteed.
Hardscape & Construction Standards:
All installations are completed according to:

ICPI (Interlocking Concrete Pavement Institute) standards for pavers
-
Manufacturer specifications
-
Regional construction best practices
Minor settling or natural material variation may occur and is considered normal.
Client Responsibilities:
Client agrees to:

Provide access to the property
-
Maintain proper irrigation and care after installation
-
Keep pets and occupants clear of active work zones
Property Use & Access:
The Company reserves the right to:
-
Access the property during working hours
-
Store materials and equipment on-site as needed
-
Use images of the project for marketing and portfolio purposes
Limitation of Liability:
Emerald Lawn & Land Creations shall not be held liable for:
-
Damage caused by pre-existing conditions
-
Acts of nature (storms, flooding, drought, etc.)
-
Improper maintenance by the client
-
Third-party interference
Liability is limited to the value of the contracted services.
Indemnification:
Client agrees to indemnify and hold harmless Emerald Lawn & Land Creations from any claims arising from:

Misuse of installed features
-
Failure to maintain property
-
Unauthorized modifications
Termination of Services:
The Company reserves the right to terminate services if:

Payment terms are not met
-
Site conditions become unsafe
-
Client breaches contract terms
Governing Law:
These Terms & Conditions shall be governed by the laws of the State of Georgia.
Updates to Terms:
We reserve the right to update these Terms & Conditions at any time. Continued use of services constitutes acceptance of updated terms.
